Structure/function claims for practice-dispensed supplements

A supplement may say how it supports normal structure or function. It may not say it treats anything, and the disclaimer has to travel with the claim.

What is allowed

Structure/function claims describe a nutrient’s role in normal body structure or function, and must carry the FDA disclaimer: "These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease."FDA: structure/function21 CFR 101.93

What the FTC adds

The FTC expects health claims to be supported by competent and reliable scientific evidence, and a practitioner’s recommendation carries the same burden as the label.FTC guidance 2022 If you are paid to recommend a product, that material connection has to be disclosed.FTC endorsement guides
